ZAMCO provides this Privacy Policy so you know about ZAMCO’s online information practices and understand how ZAMCO treats the information we receive about you from your use of www.zamcodataservices.com (the “Site”). ZAMCO takes privacy and data protection issues very seriously. ZAMCO’s Privacy Policy applies to personal information collected from merchants who contract with ZAMCO to use our services, as well as consumer information that ZAMCO may acquire in the course of our business.
By using, browsing and/or accessing the Site, you agree to the terms of this Privacy Policy. Your visit to the Site and any dispute over privacy is subject to the Terms of Use, including limitations on damages and application of the law of the State of Minnesota. Use of this Site is strictly voluntary. If you do not agree to the Site’s Privacy Policy and Terms of Use, you must immediately log off the Site and may not use the Site.

Collected
ZAMCO collects information from its merchants through an application process used to establish an account to utilize our services. ZAMCO does not obtain information from individuals or companies via the Site. We only obtain information from when an individual or company applies for an account to use our services. At that time, we will ask for contact information (such as your name, street address, phone, fax and e-mail address), and information pertaining to your business, including but not limited to current financial statements, bank account and/or settlement account information, and how you will utilize ZAMCO’s services. Additionally, to process individual transactions for merchants, we typically will receive from the merchant information related to the specific transaction. This might include information about the transaction that a consumer has furnished the merchant in placing the order for example. Any personal information we might receive in processing transactions varies according to the nature of the transaction and the way in which merchants are using our services. Generally, though, the information will include customer information, banking information and transaction information. Personal consumer information is used to process payment transactions and for no other purpose.
The Site utilizes cookies. “Cookies" are anonymous, unique identifiers that are on some of our web pages on the Site that may send data to our web server or store data on your computer. When you visit the Site you necessarily disclose your computer’s Internet protocol (IP) address. Your IP address is a number that is used by computers connected to the Internet to identify your computer so that data (such as the web pages you request) can be sent to your computer. ZAMCO uses cookie data to “recognize” you when you visit the Site in the future, and may also use it for internal analysis of how people use the Site and trouble-shoot how the Site operates. ZAMCO also may disclose information in any of the following circumstances: (1) for ZAMCO to complete the merchant transaction; (2) in response to a subpoena, search warrant, court order, or other legal process or request, or as may otherwise be required by applicable law or regulation; (3) to protect and defend ZAMCO’s rights or property or those of its affiliates, dealers, business partners, or others; or (4) as ZAMCO, in its sole discretion, believes is appropriate under exigent circumstances in response to a perceived threat to the personal safety, property, or rights of any other person or organization.
In addition, since ZAMCO’s database is a business asset, in the event ZAMCO is reorganized or is sold to or merged with another company, you consent to the sale, assignment, or transfer of your personal information to a purchaser of all or substantially all of ZAMCO’s business assets, or to an affiliate, as applicable.

Security of Your Information
Information security is critical to our business and ZAMCO strives to protect all information transmitted to or from this Site. However, ZAMCO cannot ensure or warrant the security of any information transmitted to or from this Site, by e-mail or otherwise, and this information is provided at your own risk. ZAMCO works to protect the security of consumers’ information as well as our merchants through the use of security and encryption software. Any information that is gathered, rather than merely passed through as part of a transaction, is stored on servers located in a secure data center. The number of people with access to these servers is very limited. Firewalls and other security technology are used to prevent system servers and computers from being accessed by unauthorized persons. It is the merchant’s responsibility to protect against unauthorized access to the system through misuse of individual Merchant ID, User Name and Password. To assure of no unauthorized access, please be certain you log off the system when finished with your session and protect your Merchant ID, User Name and Password used to access your merchant account.

Changes to Privacy Policy
ZAMCO reserves the right to modify this Privacy Policy, in whole or in part, at any time without notice to you. You expressly waive any right to receive notice of any changes to this Privacy Policy. You should check the Site frequently to see recent changes to ensure you are aware of current practices. Any use of the Site following the date on which ZAMCO implements changes to this Privacy Policy shall constitute your acceptance of all such changes.
